The Control of Asbestos Regulations 2012 came into force on 6th April 2012 revoking and replacing the previous regulations issued in 2006. The changes now bring UK legislation in to line with the standards of the EU Directive on the protection of workers from the risks to exposure to asbestos at work.

The main changes to the regulations affect the current “Non-Licensable” work on asbestos. The “Non-Licensable” category is now split into two and an additional category has been included which is termed as “Notifiable Non-Licensable Work” (NNLW). This category is between the current “Non-Licensable” and “Licensable” categories.

Any asbestos related work which comes under the NNLW category requires the following:

work be notified

each worker exposed must have medical surveillance every three years

the employer must maintain a register for each worker of the type and duration of work done with asbestos – to be kept for 40 years along with copies of all medicals.

The new regulations can be found at http://www.legislation.gov.uk/uksi/2012/632/pdfs/uksi_20120632_en.pdf
